Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the GoofCam: Funny Face Filters app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

GoofCam is a camera app that adds live face lenses, camera effects, and photo frames to still photos you take. Camera processing and face tracking happen on your device. Photos are saved to your device's photo library only when you choose to save them, and shared only through your device's share sheet. The App does not record video. GoofCam is planned for the Apple App Store for iPhone and iPad and for Google Play for Android. These Terms apply on each platform.

Eligibility

GoofCam is made for families. If you are under the age of majority where you live, use the App with the permission of a parent or guardian. A parent or guardian should approve any purchase and supervise sharing.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms and the usage rules of the store you obtained it from.

Free Features

The App is free to download and use. It contains no advertising and requires no account. Every lens, including Pro lenses, can be tried live in the camera without payment. We may change which features are free or included in GoofCam Pro, subject to applicable platform policies and the Changes to Terms section below; a change will not remove features from a GoofCam Pro purchase you have already made.

In-App Purchase: GoofCam Pro

The App offers a single optional in-app purchase, GoofCam Pro: a one-time, non-consumable lifetime unlock. It unlocks taking photos with the Pro lenses and using the Pro photo frames, and removes the small goofcam mark from saved and shared photos. Free photos include that mark. Its current local price is shown by the App Store or Google Play before you confirm. GoofCam Pro is not a subscription: there is no recurring charge and nothing auto-renews.

  • Payment is charged to your Apple Account or Google account at confirmation of purchase, and is processed entirely by Apple or Google. We never see your payment details.
  • Use Restore Purchases in the App to restore GoofCam Pro on compatible devices signed in to the same store account. Purchases do not transfer between the App Store and Google Play.
  • For an App Store purchase, you can request a refund from Apple. For a Google Play purchase, you can request a refund through Google Play or contact LightPath support. Refunds are subject to the applicable store policies and consumer law. If a purchase is refunded, access to GoofCam Pro may be removed from the App.
  • Nothing in these Terms limits any right to a refund or remedy that you have under applicable consumer law.

Intellectual Property Rights

The App and its original content, including its lenses, effects, frames, artwork, and functionality, are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You own the photos you take with the App. We claim no ownership of them and never receive them. You may share photos that include the App's lenses and frames for personal, non-commercial purposes.

Your Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Respect other people: get consent before photographing or sharing photos of others, and do not use the App to harass, bully, impersonate, or embarrass anyone
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could damage, disable, or impair its functionality
  • Not attempt to circumvent purchase checks, technical protections, or platform-imposed restrictions

Your Photos

  • Photos are processed on your device. We do not upload, store, or back up your photos, so we cannot recover a photo that was not saved or that you delete
  • Saved photos remain in your photo library after the App is uninstalled, until you delete them there
  • When you share a photo, the app or service you choose governs what happens to it next

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • Face tracking will detect every face or place every lens perfectly in every lighting condition, angle, or group photo
  • Every expression reaction will trigger exactly when you intend
  • The App will be compatible with every device or every future version of iOS, iPadOS, or Android

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of photos or other content
  • Loss of profits or revenue
  • Any damages arising from photos you choose to share, or from how third-party apps handle them
  • Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App and GoofCam Pro in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

Venue and Forum

Any judicial proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in those courts.

Time Limit on Claims

Any claim or cause of action arising out of or relating to these Terms or the App must be filed within one (1) year of the date the claim or cause of action arose, regardless of any statute or law to the contrary, except where prohibited by applicable law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

App Store Terms

If you obtained the App from Apple's App Store, Apple's Licensed Application End User License Agreement also applies, and Apple is not responsible for the App or its content. If you obtained it from Google Play, the Google Play Terms of Service also apply.
