Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the WhatsWorth app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

WhatsWorth is a mobile app that uses artificial intelligence to help you estimate the value of household items. You photograph an item, and the App uses AI vision to identify it, then finds real sold prices from online marketplaces to provide a value estimate.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Free and Premium Features

The App offers both free and premium features:

  • Anonymous users: 5 lifetime appraisals
  • Free account (signed in): 10 appraisals per month
  • Subscribers: Unlimited appraisals with weekly, monthly, or yearly subscription options

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple App Store or Google Play Store account settings. Refund requests must be directed to the respective store.

AI-Generated Valuations Disclaimer

Valuations provided by WhatsWorth are estimates only and should not be relied upon as professional appraisals.

  • Estimates are based on AI identification and publicly available sold price data from online marketplaces
  • Actual market value may differ significantly from the App's estimates
  • The App does not replace professional appraisals for insurance, estate, tax, or legal purposes
  • We make no guarantees about the accuracy, completeness, or reliability of any valuation

Intellectual Property Rights

The App and its original content, features, and functionality are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your photos and item data. The App does not claim any ownership over content you process using the App.

Your Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could damage, disable, or impair its functionality
  • Not attempt to circumvent usage limits or subscription requirements
  • Not use automated systems or bots to access the App

Camera and Photo Access

The App requires camera access to photograph items for valuation. You may also select photos from your gallery. By granting this access, you understand that:

  • Photos are analyzed using cloud-based AI services hosted on Google Cloud Platform for item identification and pricing
  • Photos are processed in real time and are not permanently stored on our servers
  • Item data and valuations are stored locally on your device and optionally synced to your account

Third-Party Services

The App relies on third-party services including Google Cloud Platform and marketplace data sources. These services may experience downtime, changes, or discontinuation outside our control. We are not responsible for the availability or accuracy of third-party services.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • AI identification will be accurate for all items
  • Price estimates will reflect actual market value
  • Marketplace data will be current or comprehensive

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content
  • Loss of profits or revenue
  • Financial decisions made based on the App's valuations
  • Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
