Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the RepairLens: Home Repair AI app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

RepairLens is a home repair diagnosis app for iPhone (iOS 17 or later). You photograph a home problem (a required close-up plus optional area-overview and appliance-label shots) and the App uses an AI model to produce a severity assessment, a likely cause, an ordered action plan, DIY-vs-pro guidance, and a broad cost range. You may also ask bounded text follow-up questions about a saved diagnosis. When the AI output identifies a covered gas, electrical, structural, major water or sewage, mold, asbestos, or high-tension garage-door hazard, the App escalates to an urgent get-help-now warning rather than DIY advice. Recognition is best effort and may miss a hazard.

Not Professional Advice

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Free Tier

The free tier of the App lets you save local inspection reports without an app-imposed count limit and includes two AI-assisted inspections. An inspection consumes the free allowance only after the AI analysis returns and its result is successfully persisted. Provider errors, cancellations, and persistence failures do not consume the free allowance. The free tier also currently includes up to 10 successfully returned follow-up chat replies per local calendar day; failed or cancelled chat requests do not consume that successful-reply allowance. Each actual model attempt, including a fallback attempt, counts toward a separate durable abuse-and-cost-protection ceiling of 30 attempts per local calendar day for free users. We reserve the right to change pricing, feature availability, and tier composition at any time, subject to applicable platform policies and the Changes to Terms section below.

Auto-Renewable Subscriptions

RepairLens Pro unlocks unlimited AI diagnoses, unlimited follow-up chat subject to reasonable abuse and service-availability protections, and PDF reports and is offered as an auto-renewable subscription purchased through the Apple App Store:

• RepairLens Pro Monthly: $5.99 per month
• RepairLens Pro Annual: $39.99 per year

Both plans include a 7-day free trial. The following terms apply:

• Payment is charged to your Apple ID account at confirmation of purchase or, where a free trial is offered, at the end of the trial period.
• The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your App Store account settings (Settings > [your name] > Subscriptions) after purchase. Deleting the App does not cancel the subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• All purchases are processed by Apple. Refunds are handled by Apple and refund requests must be directed to Apple.
• Prices may change; any change will be presented through the App Store in accordance with Apple's policies before it affects you.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the photos you take with the App. The App does not claim any ownership over your photos; they are processed only to generate the diagnoses you request, as described in our Privacy Policy.

Your Responsibilities

When using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Only photograph property that you own or have the right to photograph
• Not rely on the App as your sole basis for decisions affecting health, safety, or property, and consult a qualified professional for safety-critical issues
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage, disable, or impair its functionality
• Not attempt to circumvent technical protections, license checks, diagnosis limits, or platform-imposed restrictions

AI-Generated Content

Diagnoses and follow-up chat responses are generated by an artificial-intelligence model based on the photos or text context you submit. By using the App, you understand that:

• AI output can be inaccurate, incomplete, or inapplicable to your specific situation
• Cost ranges are broad estimates and actual costs vary by region, materials, access, and contractor
• A photo cannot capture everything a qualified professional would find in an on-site inspection
• The App's safety escalations are a best effort, not a guarantee that every hazardous condition will be detected

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free
• Any diagnosis, severity rating, likely cause, action plan, or cost range will be accurate, complete, or fit for your particular situation
• The App will identify every defect, hazard, or dangerous condition present in a photographed scene
• The App will be compatible with every future version of iOS

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Property damage or personal injury
• Loss of data or content
• Loss of profits or revenue
• Decisions, repairs, or actions taken (or not taken) based on a diagnosis or other output of the App
• Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

Venue and Forum

Any judicial proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in those courts.

Time Limit on Claims

Any claim or cause of action arising out of or relating to these Terms or the App must be filed within one (1) year of the date the claim or cause of action arose, regardless of any statute or law to the contrary, except where prohibited by applicable law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
