Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the MotionKeeper app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

MotionKeeper is a utility app that helps you extract and preserve video content embedded in Live Photos (iOS) and Motion Photos (Android). The App scans your photo library, identifies photos with embedded motion videos, and allows you to save those videos separately.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Free and Premium Features

The App offers both free and premium features:

  • Free tier: Includes 10 video extractions
  • Premium (one-time purchase): Unlimited video extractions

All purchases are final and processed through the Apple App Store or Google Play Store. Refund requests must be directed to the respective store.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your photos and videos. The App does not claim any ownership over content you process using the App.

Your Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Ensure you have the right to access and process any photos in your library
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could damage, disable, or impair its functionality

Photo Library Access

The App requires access to your device's photo library to function. By granting this access, you understand that:

  • The App will scan photos to identify those with embedded motion videos
  • Extracted videos will be saved to your photo library
  • All processing occurs locally on your device — photos are never uploaded or transmitted

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • All motion photos will be detected (detection depends on file format and device manufacturer)
  • Extracted videos will be of any particular quality (video quality depends on the original photo)

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content
  • Loss of profits or revenue
  • Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App (if any).

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
