Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the MeThen app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

MeThen is a progress-photo check-in app for iPhone (iOS 17 or later) and Android phones (Android 8.0 or later). It provides guided front/side/back photo check-ins with alignment guides, an on-device journal and timeline, side-by-side comparison of any two check-ins, backdated import from your camera roll, and opt-in AI features that generate trend insights and broad body-fat range estimates from photos you explicitly choose to analyze, plus text-only follow-up chat about a saved result. MeThen is currently in development and not yet available in the public app stores; these Terms apply to any pre-release access we provide and to the App upon its release.

Not Medical Advice

MeThen is not a medical device and does not provide medical advice, diagnosis, or treatment. Its AI-generated estimates are broad visual reads of photographs — presented deliberately as ranges with confidence levels and caveats, never as precise measurements — and every result carries a non-medical disclaimer. Do not use the App to make health decisions. Body-composition estimates from photos are inherently imprecise and can be wrong. Always consult a qualified health professional for medical concerns, and see our wellbeing page for guidance on using progress photos in a healthy way.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Free and Pro Features

The App's free tier includes unlimited photo check-ins, journaling, and side-by-side comparisons, plus 2 free AI analyses and up to 10 successful follow-up chat replies per day. Additional AI features are offered through the MeThen Pro subscription described below. We reserve the right to change pricing, feature availability, and tier composition at any time, subject to applicable platform policies and the Changes to Terms section below.

Auto-Renewable Subscriptions

MeThen Pro is an optional auto-renewable subscription that unlocks unlimited AI analyses and follow-up chat without a successful-reply cap, subject to a reasonable-use ceiling of 120 actual provider attempts per day and service availability. Deep Compare is also included on iOS but is not included in the current Android release. Two plans are offered:

  • MeThen Pro Monthly — $5.99 per month
  • MeThen Pro Annual — $39.99 per year

A 7-day free trial may be offered to eligible new subscribers. Trial eligibility, duration, and availability are determined by the applicable store; the purchase sheet shows whether an offer applies before purchase. Prices are in U.S. dollars and may vary by region; the price shown in the Apple App Store or Google Play at the time of purchase applies. The following terms apply:

  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase, or after an accepted trial ends, according to the offer displayed by that store.
  • Subscriptions automatically renew until cancelled. On iOS, cancel at least 24 hours before the current period ends. On Google Play, manage the subscription before the renewal date shown in your account. Google Play may place an authorization hold before renewal; timing and the effect of cancellation vary by region. The dates, price, and terms shown in your store account control.
  • You can manage and cancel your subscription in the subscription settings for the store where you purchased it at any time. Your store confirmation and subscription settings show the effective cancellation date and any continued access.
  • If a trial is offered, eligibility and any effect of changing plans are governed by the offer terms shown by the applicable store.
  • Payments and refund requests are handled by Apple or Google under the applicable store's standard process. We cannot issue app-store refunds directly.

AI Features and Consent

The App's AI features are opt-in. Before the first analysis, the App asks for consent and remembers that grant until you revoke it in Settings; every photo upload still requires an explicit Analyze tap. Analyze may include the current journal note and a compact prior-result summary. The iOS-only Deep Compare feature sends both photo sets plus the current note and earlier summary and requires separate consent for each comparison; it is not included in the current Android release. The handling of that data is described in our Privacy Policy. You acknowledge that AI-generated outputs are estimates that may be inaccurate, and you agree not to rely on them as measurements or medical information.

Follow-up chat sends the saved result summary, recent text turns, and your question to the same AI provider only when you tap Send; it does not resend photos or your optional profile. Free users receive 10 successful replies per day. Pro removes that successful-reply cap, subject to service availability and a reasonable-use ceiling of 120 actual provider attempts per day; the free tier has a separate 30-attempt ceiling. Provider attempts include fallbacks. A future app version may change these limits in accordance with applicable platform and consumer-protection rules.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your photos and any other content you create or import in the App. The App does not claim any ownership over your content.

Your Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Only capture, import, or analyze photos that you have the right to use, and only photos of yourself or of another adult who has given you their consent
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could damage, disable, or impair its functionality
  • Not attempt to circumvent technical protections, consent screens, license checks, or platform-imposed restrictions

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • AI-generated insights, ranges, or comparisons will be accurate, complete, or suitable for any particular purpose
  • Estimates will match measurements from clinical or other body-composition methods
  • The App will be compatible with every future version of iOS or Android

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content, including photos
  • Loss of profits or revenue
  • Decisions or actions taken based on an AI-generated estimate, insight, or comparison
  • Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

Venue and Forum

Any judicial proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in those courts.

Time Limit on Claims

Any claim or cause of action arising out of or relating to these Terms or the App must be filed within one (1) year of the date the claim or cause of action arose, regardless of any statute or law to the contrary, except where prohibited by applicable law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
