Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the LooksGauge app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

LooksGauge is a mobile app for your own grooming, style, and photo presentation. You take or import a selfie and, with your consent, the App uses an AI model to generate a fun 0–10 Looks Score, a Potential Score, a per-area breakdown (skin, hair & grooming, style & fit, expression, and photo quality), and encouraging, specific tips and text-only follow-up chat about a saved scored result. The App also offers guided capture and a re-scan timeline with a Compare view. Selfies and results are stored in the App's private local storage, which the App marks for exclusion from device backups; the App has no accounts.

Entertainment and Self-Improvement Only — Not Advice

LooksGauge's scores and tips are AI-generated, designed to be fun and motivating, and carry a disclaimer on every result. They are not medical, dermatological, psychological, or other professional advice, and they are not an objective measurement of appearance or worth. AI-generated output can be inaccurate or inconsistent. Do not rely on the App for health or appearance-related decisions — consult a qualified professional for those.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Free Scans and LooksGauge Pro

The App includes 3 free AI analysis attempts. A run is reserved immediately before a request is submitted and is not restored if that request is refused, later fails, or is interrupted. LooksGauge Pro lets you run new scans without a cap. Full results, the Potential Score, progress tracking, compare, and sharing an insight remain available without a Pro subscription. We reserve the right to change pricing, feature availability, and tier composition at any time, subject to applicable platform policies and the Changes to Terms section below.

Auto-Renewable Subscriptions

LooksGauge Pro is offered as an auto-renewable subscription with monthly and yearly options. Eligible new subscribers can start a 7-day free trial; the localized price is shown before purchase in the App and on your store's purchase sheet.

For iPhone subscriptions, the following terms apply to both options. Android subscriptions follow the Google Play purchase sheet and the Android platform details above:

• Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial if you started one.
• The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your App Store account settings (Settings > [your name] > Subscriptions on your iPhone).
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• All payments are processed by Apple, and refunds are handled by Apple under its policies. Refund requests must be directed to Apple.
• The localized price shown by Apple may vary by storefront and may change in the future subject to App Store policies; any change will apply no earlier than your next renewal.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the photos you take or import into the App. The App does not claim any ownership over your photos or the scan results generated from them.

Your Responsibilities

When using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Scan only yourself — the App is a coach for your own glow-up, not a tool for rating other people
• Not use the App or its output to harass, demean, or shame anyone
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage, disable, or impair its functionality
• Not attempt to circumvent technical protections, scan limits, or platform-imposed restrictions

AI Processing of Your Photos

Generating a score requires sending your selfie to our AI provider, Google (Gemini via Firebase, Vertex AI backend), and this happens only after you explicitly consent to AI analysis. That choice is remembered and can be revoked in Settings; every upload still requires you to tap Scan. Location and camera metadata are stripped first; the photo is not used to train AI models. Google says published Gemini models may keep an in-memory, project-isolated cache for up to 24 hours and may retain prompts flagged for abuse monitoring for up to 90 days. Follow-up chat sends the saved scan summary, recent text turns, and your question to the same AI provider only when you tap Send; it does not resend your selfie. Free users receive 10 successful replies per day; Pro follow-up chat is unlimited. Separate abuse-prevention ceilings permit up to 30 actual provider attempts per day on the free tier and up to 100 on Pro, including fallback attempts. These limits and feature availability may change in a future app version or service configuration.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free
• Scores, breakdowns, or tips will be accurate, consistent between scans, or fit for any particular purpose
• The AI analysis service will always be available — it depends on third-party providers and a network connection
• The App will be compatible with every future version of iOS

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or content
• Loss of profits or revenue
• Emotional distress arising from scores or feedback
• Decisions or actions taken based on the App's scores or tips
• Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

Venue and Forum

Any judicial proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in those courts.

Time Limit on Claims

Any claim or cause of action arising out of or relating to these Terms or the App must be filed within one (1) year of the date the claim or cause of action arose, regardless of any statute or law to the contrary, except where prohibited by applicable law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
