Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and LightPath Apps LLC ("we," "us," or "our") concerning your use of the Cadence Lift app (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

Description of Service

Cadence Lift is a weightlifting logger for iPhone (with an Apple Watch companion) and Android (with a Wear OS companion). It records the workouts you log, suggests weights and reps based on your own history, and shows your progress over time. The App requires no account: your workout history, templates, and preferences are stored on your device.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Pricing

Cadence Lift is currently free, with no ads. If a paid tier ever lands, it would gate features that cost money to deliver — such as cloud sync or an AI weekly review — not core logging. We reserve the right to change pricing, feature availability, and tier composition at any time, subject to applicable platform policies and the Changes to Terms section below.

App Features and Third-Party Services

Most of the App runs entirely on your device. The following features involve our servers or third-party services:

  • AI Coach (optional).The App includes an optional AI Coach that gives feedback grounded in the workouts you've logged. It does nothing until you use it, and the first time you do, you must accept an in-app consent screen. When you use the Coach, a summary of your logged training is sent to our processing service and to our AI provider, Google (via the Gemini API), solely to generate your coaching response.
  • Share workout link (optional). You can publish a single workout to a public, unlisted web page and send the link to anyone. Nothing is uploaded unless you tap the share option, the link is reachable by anyone who has it, and it expires automatically. Treat a workout as public once you share its link. The Markdown, JSON, and copy export options never touch our server.
  • Rest-timer Live Activity relay (iPhone). To keep the Lock Screen / Dynamic Island rest timer current, the App sends a small transient payload through our relay each time you log a set while Live Activities are enabled. The payload is deleted after delivery, and you can stop this traffic entirely by disabling Live Activities for Cadence Lift.
  • Apple Health and Health Connect (optional). If you grant permission, the App writes finished workouts and body-weight entries to Apple Health (iPhone) or Health Connect (Android) and can read data back at your request. That data is stored on your device by Apple or Google under your control and governed by their terms — it is not part of our records, and we are not responsible for those platforms.

These features are described in detail in our privacy policy. We may rely on third-party services (such as Cloudflare, Google, and Apple's push service) to deliver them and are not liable for interruptions in those services.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by LightPath Apps LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to the training data you log in the App. The App does not claim any ownership over content you create using the App.

Your Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Take responsibility for the accuracy of the training data you enter — weight suggestions, personal records, and AI Coach feedback are all derived from what you log
  • Exercise at your own risk, use appropriate equipment and technique, and stop if you experience pain or injury
  • Not share unlawful or infringing content through the Share workout link feature
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could damage, disable, or impair its functionality, or abuse our relay, sharing, or AI Coach services

Not Medical or Coaching Advice

The App's suggestions, statistics, and AI Coach feedback are informational only. They are generated from the data you log and do not constitute medical advice, physical-therapy advice, or a substitute for a qualified coach or physician. Consult a medical professional before starting or changing an exercise program, and use your own judgment about what your body can safely do.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • Weight and rep suggestions, estimated one-rep maxes, or other derived statistics will be accurate or appropriate for you
  • The AI Coach, Share workout link, or rest-timer relay will be available at all times
  • The App will be compatible with every future version of iOS, watchOS, Android, or Wear OS

Limitation of Liability

IN NO EVENT SHALL LIGHTPATH APPS LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content
  • Personal injury arising from your training decisions
  • Decisions or actions taken based on the App's suggestions, statistics, or AI Coach feedback
  • Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless LightPath Apps LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may revise these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

Venue and Forum

Any judicial proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to personal jurisdiction in those courts.

Time Limit on Claims

Any claim or cause of action arising out of or relating to these Terms or the App must be filed within one (1) year of the date the claim or cause of action arose, regardless of any statute or law to the contrary, except where prohibited by applicable law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
